Awaited verdict over instant Triple Talaq has been declared on Tuesday , 22 August 2017 which came up with historical decision of banning such practice in India and so from now Muslim men can not give divorce to their wives just by uttering Talaq for three times which was happening from past so many decades.
The very first petition which got so much limelight was filed by Shayra Bano back in 2015 who rose her voice because her husband wanted to call off the 15 years long marriage and he did so by opting the means of triple talaq later some other women also joined her, matter got lot of coverage into media which in turn created lot of pressure over people in power and thus within the time span of just 2 years we got verdict.
For this very case, Supreme court had formed a panel of 5 male members who all were from different religions i.e Hinduism , Islam , Sikhism ,Christianity and Zoroastrianism . The verdict was not the result of full favor of side rather there was a division of views in the ratio of 3:2 in which 3 were in favor of verdict.
Thing which need to be known is that there were 3 types of divorce practiced in Islamic Community in India : Firstly ‘Talaq-e-ahsan’ in which husband pronounces the term talaq but then period of 90 days or 3 menstrual cycle is being given to rethink over the issue then secondly there is ‘Talaq-e- hasan’ in which husband pronounces Talaq for 3 times over 3 months with gap of one month each and lastly ‘Talaq-e-biddat’ in which husband pronounces talaq for 3 times in one go.
So as per the current verdict , the last case of divorce i.e ‘Talaq-e-biddat’ has came to an end in India which is already been banned in many of the Muslim countries like Saudi Arabia , Pakistan , Afghanistan , Iran ,Iraq etc many years as found wrong and sinful.
The torch bearer of the case ,Shayra Bano stated “This is a historic day for muslim women .No muslim women will have to go through the harassement that I suffered.I am happy that my 11 year old daughter will not have to face such regressive practice when she grows up”
As per the prime minister ,”Judgement of the Hon’ble SC on triple talaq is historic . It grants equality to Muslim women and is a powerful measure for women empowerment” it actually happen very rarely when the decision is being welcomed politically by the oppositions too but this time fortunately happened the same thing as Vice president of congress party stated “Welcome the Supreme Court decision setting aside instant triple talaq.I congratulate the women who fought for justice”
To say final goodbye to ‘Talaq-e-biddat’ was actually the need of the time as there were plenty of tales of woe and a lot many cases of domestic violences , harrasements and assaults which was being recorded as held against women of muslim communities due to this very form divorce .
